Permission Guidelines

Authors often ask us to clarify what they are and are not responsible for when it comes to permissions, artwork, quoting from other sources, and indexes.

In brief, unless otherwise noted in your contract, you are responsible for obtaining permission (and paying any fees) for all copyrighted material that you use in your book.

This includes:

  • More than 500 words taken from any single printed source not in the public domain
  • Any substantial proportion of a shorter printed work (even if it’s less than 500 words)
  • More than a line or two of poetry or song lyric not in the public domain
  • All copyrighted artwork and photography
  • All tables and charts taken from any copyrighted source
  • Possibly even portions of your own writing if they have been published elsewhere
  • Prose quotations or the close paraphrasing of 500 words or more from any full length book (either a single citation or the total of several shorter quotations from a single work.
  • Prose quotations or the close paraphrasing of 100 words or more from an article or periodical piece.
  • More than 300 words from a full length play or 100 words from a one act play.
  • One or more lines of a poem, unless it is of epic proportion, in which case more lines may be used depending on their qualitative and quantitative relationship to the entire copyrighted work. 


There are no hard and fast rules that govern the application of fair use, since each instance has its own particular set of facts that must be weighed in determining whether a ‘use’ is “fair use.” To make such a determination, please take into account the following factors:

  • The length of the quoted passage in relation to the length of the copyrighted work from which it is taken (not in relation to the work in which it is used by the borrowing author).
  • The qualitative significance of the passage in relation to the copyrighted work as a whole; that is: is the passage the ‘heart’ of the copyrighted work or merely an incidental or minor segment?
  • The manner in which the borrowed passage is used:
    • Is the passage used in an illustrative, critical, or instructive context?
    • Is the passage borrowed passage?
    • Is the passage quoted within the text of the book for purposes of comment or criticism?
  • The nature of the copyrighted work from which the passage is taken: is it a published or unpublished source? (The scope of the fair use privilege is significantly reduced for unpublished works.) Is the passage factual and mostly informative in content, or is it more expressive and fanciful, more “literary”?
  • The effect of the use of the material on the potential market for the copyrighted work, including the market for granting rights and permissions to use the copyrighted work.


Fair Use Also Includes:
 
- Personal use for yourself only (making photocopies only for yourself, not distributed to others).


- Scholarship/Research (including text in a thesis or research project).

These guidelines only apply to reproduce excerpts or selections from a Zondervan book. They do NOT apply to reprinting or translating an entire Zondervan book.


Please Note: You must use the copyright laws in the Country you are using the material in. If you are using the material in the U.S. you must abide by U.S. Copyright laws. If you are using the material in another Country, you must abide by their laws. 


Permission Fees

 

  • Fees are determined based on the amount of material being used, the distribution of that material, and whether your usage is defined as commercial or non-commercial.
  • Our fees are established to compensate our authors fairly for further usage of their copyrighted material.

The following copyright must accompany all reprints:

Permission Requests

  • If possible, please do not call to inquire about your request, as answering calls delays the permission process.

  • All requests will be handled in the order received. Response times vary and depend on the number of incoming requests.
  • Every effort will be made to respond as soon as possible, or to accommodate specific due dates.

Third-Party Material


Before submitting your request, please pay special attention to the material you are requesting permission to use.
  • Zondervan cannot grant permission for any third-party material (which is material used by permission of another source).
  • You will need to contact the original publisher/author of the material to receive permission to quote any third-party or quoted material which appears in any of our publications.


Out of Print

  • If requesting permission to reprint entire out-of-print text, please submit a written or electronic request, using the permission request form or mail to:

Text and Image Requests

  • Zondervan text and images can be made available in JPG or PDF formats for a fee of $100.00 per file. Files can be supplied on a CD, by email, or to an FTP site.

Seasonal Titles Text and Image Requests
The following seasonal books contain a number of illustrations in each book. Please indicate on your permission request form how many illustrations you would like to use and their primary use.

  • Mary's First Christmas: 23 illustrations
  • Legend of the Candy Cane: 14 illustrations - Legend of the Christmas Tree: 14 illustrations
  • Legend of the Christmas Stocking: 15 illustrations


Advertising Requests

  • Permission is NOT necessary if you are using the material for advertising purposes. This includes images of our book covers.
